BARRIE, Ont. — A man accused of deliberately killing his girlfriend’s puppy by slamming it on the floor because he was jealous has been released on bail.

Ryan Anthony Baklarz, 23, who is charged with killing an animal, was released on $2,500 and allowed to go home with his mother on Friday.

In court, the prosecution alleged Baklarz killed the fluffy six-month-old Pomeranian puppy named Angel in a jealous rage because his girlfriend was out with a friend with whom she was once in a relationship.

The accused picked up the dog and slammed it on the hard tile floor, causing the dog’s death,” Crown attorney Jennifer Armenise said. “He then put the dog in a plastic bag, tied it and left it on the floor in front of the refrigerator.”

There was no publication ban placed on the bail hearing.

Sitting in her downtown Barrie apartment, with her Irish terrier at her side, girlfriend Ashley Berdan was still weepy Friday as she showed off pictures of Angel, a buff-coloured ball of fluff with big brown eyes. One photo shows the pup wrestling with a red ball, another with its head stuck in a jar of peanut butter.

“She had a thing for peanut butter,” Berdan said fondly.

Confined to a wheelchair for life, she said her dogs bring her great joy.

“My dogs are my life,” Berdan said.

Court heard that Berdan got a text from Baklarz stating: “I killed the dog.”

But, sitting in her apartment, Berdan said she didn’t believe him until she returned home Sunday around 7 p.m. and found a bag on the floor with something soft in it.

“I cried all night and when I woke up I cried again,” Berdan said.

She didn’t want to call police on her own boyfriend but a friend who was with her went outside and flagged an officer on the street, Berdan said.

She doesn’t understand why this happened. “He is normally a sweetheart,” Berdan said of Baklarz.

Baklarz, who has no criminal record, will be back in court Sept. 23.

Update August 21, 2013 10:35 a.m:Since the District Attorney‘s office is considering an appeal, the petition asking for the maximum sentence (link is below) has been reopened for signatures.

In April, 2012, an 18-year-old man was arrested and charged with animal cruelty.Darius Ewing poured lighter fluid on a four-month-old puppy, then flicked a lit cigarette at him. The police report stated that a group of people watched and laughed as Ewing threw his lit cigarette at the dog.

The Labrador puppy suffered from third degree burns on more than 70 percent of his body. His poor little body could not handle it, and ten days after being set on fire, the puppy died.

The puppy was named “Justice” by his rescuers, DFW Rescue Me, since that is what they hoped he would get.

But that does not seem to be the case.

The man who lit Justice on fire, Darius Ewing, pleaded guilty to one count of felony animal cruelty. Ewing entered a plea on Tuesday, agreeing to a five-year sentence. The judge on the case, Larry Mitchell, reduced his sentence to two years. WFFA.com reports that the judge “lowered it to two years, saying prosecutors failed to prove that a ‘deadly weapon’ was used.”

Three others also pleaded guilty to one count each of felony animal cruelty. Darius Carey, 25, was sentenced to two years in jail. Richard Valentine, 25, and Adrian Ayers, 21, each received 15 months in jail.

In Texas, State Jail Felonies are punishable with a fine of up to $10,000 and/or a jail sentence of up to 10 years.

Jonnie England of the Texas Humane Alliance says all who were present for sentencing in the courtroom were shocked. “There was just no justice for Justice here today,” England said.

Prosecutors are considering an appeal for Ewing’s case.

Animal advocate group Hand4Paws wrote a petition asking that Darius Ewing receive the maximum sentence. The petition received over 37,000 signatures. The petition was sent to the judge on the case, Larry Mitchell.

“WTF….if the owners don’t allow their dog to be in the boot of the car in it’s crate; I pity how the poor thing lives at home!! If that’s how they feel then they shouldn’t have pets at all; bloody heartless morons!!”

A South Carolina animal control officer went above and beyond her call of duty when she spent two hours following an SUV that had a dog strapped outside of it.

Nicole Hubbard and her boyfriend were driving along the I-95 in Georgia when they noticed an airline crate attached to the cargo holder of a Dodge Durango.

“We were riding back from a family vacation,” Hubbard said. “We thought, ‘Surely, they don’t have a dog in the back of it.’ But when we got up next to it, there the dog was.”

A beagle mix was inside the crate, which was positioned directly behind the tailpipe, sending exhaust right through the carrier. Hubbard noticed there was no water container for the pup (which probably would have sloshed around anyway).

How Utterly Stupid & Ignorant

With it being 94 degrees out, she was concerned that the dog could become very ill from the heat and exhaust, not to mention the anxiety of being in a crate on the outside of a vehicle.

Though it appeared securely rigged with bungee cords, a bad bump could have knocked the carrier off and into the path of another vehicle.

She immediately informed highway patrol, who told her an officer would be dispatched to pull the vehicle over.

“We stayed behind them, and no officer ever came,” she said. She called again, but this time was told police couldn’t respond.

“They said they just don’t have an officer to send,” Hubbard said.

The couple continued to follow the SUV for about two hours, until they crossed the South Carolina border. She called the SC highway patrol, who showed greater concern for the situation.

“They were wonderful,” Hubbard said.

An operator kept her on the line until a trooper could be sent to the area. Finally, the SUV was pulled over.

Hubbard does not know if the driver was issued a summons. It is unlikely that what was done would legally be considered animal cruelty, but it certainly falls under the definition of stupidity.

Hubbard said keeping a dog in a crate by an exhaust pipe with no water on such a hot day was unacceptable.

There wasn’t even enough room for the dog to turn around inside.

“I was just amazed that somebody could be that uneducated of the dangers with that dog being there,” she said. “Hopefully, they learned something from it.”

Distressing news on Thursday when the New Jersey Society for the Prevention of Cruelty to Animal’s Law Enforcement Division joined with the Hunterdon County Prosecutor’s Office and issued two search warrants for the Hunterdon Humane Animal Shelter on Stamets Road in Alexandria Road and a nearby veterinarian hospital.

According to N.J.com, Captain Rick Yocum, the president of the New Jersey Society for the Prevention of Cruelty to Animals stated an investigation has been ongoing because of complaints about inhumane conditions at the facility.

Seventeen cats were removed and were transported to the Flemington Animal Hospital. Four of the cats were humanely euthanized. All of the animals have been receiving medical attention. The facility failed to quarantine sick cats with respiratory infections thus spreading illness to healthy cats.

There are also two pigs living in terrible condition at the facility. A decision from the Department of Agriculture will determine their fate.

Charges are expected to be filed within a week to ten days.

GROSSE TETE — How do you get a 550-pound Bengal tiger that lives in a cage at a truck stop to crawl into his newly built pool?

Drop a bloody hunk of mixed, ground horse meat and beef on a corner of the tiger’s new wooden pool deck?

Nope. That didn’t work.

Pour electric blue-colored Dawn dishwashing liquid into the pool water to create a bubble bath?

Tony isn’t interested in his new pool!!

Even though the temperature was north of 90 degrees Thursday afternoon, Tony the tiger just wouldn’t budge.

“Too many cameras around. He must be nervous. He’s curious though. I’m sure he’ll get in later when everybody is gone,” said Mike Sandlin, Tony’s owner and owner of the Tiger Truck Stop off Interstate 10 in Iberville Parish.

Instead of jumping in right away, Tony paced inside his 3,200-square-foot steel cage, then plopped down in a far corner.

Tony and his newly built pool are about 96 miles from the Louisiana Supreme Court in New Orleans, where justices will decide in weeks or months to either take up an appeal by Sandlin to allow the tiger to remain at the truck stop or allow a ruling by the state’s 1st Circuit Court of Appeal to stand.

If the appellate court’s ruling stands, Sandlin will be forced to send Tony, his “baby,” to another location.

“As long as God provides me breath and money, I’ll keep fighting to keep Tony here,” Sandlin said between patting beads of sweat on his neck with a hand towel.

The Animal Legal Defense Fund, the nonprofit group that wants Tony removed from the truck stop, didn’t seemed impressed Thursday with Tony’s new pool.

“The bottom line is they can put all the bells and whistles they want to out there. You still have a tiger in a truck stop,” Animal Legal Defense Fund attorney Matthew Liebman said.

“Legally speaking, the pool doesn’t change anything,” Liebman said by telephone from California.

The state 1st Circuit Court of Appeal in Baton Rouge ruled in April that Tony cannot continue to be housed in an exhibit at the Grosse Tete truck stop where he has lived for 12 years.

The appellate court has refused to reconsider its decision.

Sandlin’s truck stop has been displaying tigers for 25 years.

Tony, a 13-year-old tiger, was sold to Sandlin by a Texas exotic animal breeder when the creature was 6 months old.

State District Judge Mike Caldwell ruled previously that a 2006 Louisiana law bars the state Department of Wildlife and Fisheries from renewing Sandlin’s permit to house Tony at the truck stop.

The 1st Circuit’s April decision affirmed that ruling.

The appellate panel, however, overturned Caldwell’s decision to allow the Animal Legal Defense Fund to intervene in a civil lawsuit on the side of four Louisiana residents who wanted Tony sent to an accredited wildlife sanctuary.

Caldwell concluded the state agency violated its own rules by exempting Sandlin and Tiger Truck Stop from permit requirements for owners of big cats.

The judge ruled a state permit can be issued only to an individual, not a corporation.

Tiger Truck Stop was the permit holder, not Sandlin, the judge said.

The truck stop’s last annual state permit expired in 2011.

Sandlin contends he has held a federal permit to keep tigers at the truck stop since 1988.

Tony’s ultimate fate hinges on what the state Supreme Court does with Sandlin’s appeal.

In the meantime, Tony has a new pool to cool off in thanks to the man who raised the $3,800 to build it, Joe “Joe Exotica” Schreibvogel.

Schreibvogel, who arrived in Grosse Tete on Wednesday with a construction crew of five, said he raised the money for Tony’s pool from viewers of his daily Internet television show, “Exotic Animal TV Starring Joe Exotic.”

Sandlin has said if he is forced by the courts to eventually send Tony away, he will send the tiger to Schreibvogel’s animal park, G.W. Exotic Animal Park in Wynnewood, Okla.

Schreibvogel said he owns 173 tigers.

“I can tell you that I’ve been out here three times,” Schreibvogel said Thursday afternoon. “And I can tell you this: There is no animal sanctuary in America that has this nice of a cage.”

When asked about concerns for Tony voiced by animal rights activists, Schreibvogel shot back, “If they cared so much for Tony, why didn’t they build him a pool?”

Lynn Dool, a truck driver from Ontario, Canada, said he read about Tony’s story online and stopped by Thursday to get a glimpse of the tiger.

“He seems domesticated. He’s been here for 12 years and there haven’t been any problems. I say let him live here,” Dool said.

“How the hell could she let the mare get so bad & not ask for help or advice as to why the horse wasn’t gaining weight? Any real horse owner knows’ that teeth need to be filed down at least once a year! I get my horse done twice as it doesn’t take long for a tooth to start irritating the gum due to being sharp or hooks to cause pain, which will stop the horse eating properly. How come it took until it was on it’s last legs before someone noticed it? Was it locked away where nobody could see it? I just can’t fathom why nobody spoke up earlier, perhaps then the mare may have stood a chance! Sod falling out with neighbours; when an animals life is in danger, you speak up!! Didn’t the previous owner see it’s condition going down? So many questions because this just shouldn’t happen in this day & age!”

Floral City, Florida – “I cried her name, I said, ‘Mary, Mary — how could they do this to you?'” says a sobbing Cheryl Pence. 

She’s talking about Mary, an Arabian mare she used to own. She saw Mary again Thursday afternoon, right before she died.

When animal control officers arrived at the horse‘s current home near Floral City, Mary was down on the ground, too weak to stand — simply a breathing carcass.

“Deplorable, emaciated, there’s really not a term for it — it’s beyond emaciation,” says Animal Control Officer Terry Funderburk of the horse’s condition.

The horse’s owner, Tammi Kampman, was arrested and faces an animal cruelty charge. A vet says the mare’s teeth were so uncared for, that she could not physically eat.

“It had no way to process the food put in front of it,” explains Animal Control Supervisor Lora Peckham. “It literally starved to death, because of a lack of medical care.”

The arrest report indicates that over the past year people in this rural neighbourhood, including other horse owners, had offered to help the family. And Pence, who had given the family Mary four years ago so their girls could ride, begged to get Mary back.

“I said, ‘but if you can’t take care of her, I can take her back. I’m happy to take her back; I love this horse,'” Pence says.

But according to Citrus County Animal Control, no one called them to report the neglected horse. Some residents told investigators they didn’t want to cause hard feelings in the neighbourhood and Pence thought someone else had picked up the phone. “In situations like this I would rather fall out with a whole bloody City; than not report a suffering animal!”

When 10 News knocked on the mobile home’s door today, we were told to go away, so we don’t know why this horse was allowed to suffer for so long. However, we did see several cars at the house and a bass boat out back.

“She took no action to get a vet on property,” said Peckham.

Yet, because there isn’t an indication of “intentional abuse”, Peckham explained that state law allows only a misdemeanor charge. Kampman bonded out of jail on Thursday. “Perhaps not intentional abuse but the owner isn’t blind, she saw the state of the horse & didn’t get a vet out….I call that intentional negligence, which should be accountable for as it is clearly animal abuse to leave a horse in that condition!” 

Mary was so far gone she had to be euthanized and her former owner is now left with photographs of better days and a gnawing guilt.

Appalling, horse starved to death

“She’s in horse heaven and she’s not suffering,” says Pence. “But I will never do that again. I will never give away a horse again.”

Animal Control Officers say it’s important for people to officially report animal abuse or neglect. And if owners find themselves in a situation where they don’t have the money, time, or will to properly care for animal, officials urge owners to ask county agencies or area rescue groups for help.

Like all horses who are forced to pull carriages, Jerry has to work in all weather extremes, including the scorching summers and the bitter winters of Salt Lake City. He hauls tourists through the busy, congested downtown streets, inhaling fumes and competing for road space with honking cars. Last weekend, while pulling tourists, he apparently succumbed to the 98-degree heat and collapsed. The heat radiating off the black asphalt on which he was pulling a carriage would have been far, far hotter than 98 degrees.

Jerry was too weak to stand, so his handlers tied ropes around his body and dragged him into a trailer.

SHARK has filed two complaints with the Veterinary Medical Board of California against Tim Eastman, the veterinarian of record for the California Rodeo Salinas. The first complaint deals with his apparent underreporting of the number of injured animals, while the second deals with his lack of care for those same injured animals.

In his report of injuries that is mandated by state law, Eastman stated that only three animals were injured. SHARK, however, video-documented twenty-three animals that had been injured during the rodeo. A video showing each of these injured animals has been published on YouTube.

California law (4830.8 of the Business and Professions Code) states that,“attending or on-call veterinarians at a rodeo event are required to report to the Veterinary Medical Board any animal injury at the event requiring veterinary treatment within 48 hours of the conclusion of the rodeo.”

On the California Veterinary Medical Board website it states that “Anyone who witnesses or believes that a licensed veterinarian or unlicensed person’s behaviour or activities may cause harm (or the potential for harm) to animal patients or may be illegal, can file a complaint.”

If Eastman allowed up to twenty animals who suffered visible injuries to go untreated, then his behavior caused them harm. If he did treat the animals, then his filing with the California Veterinary Medical Board was false. Either way, we believe he violated the law.

SHARK has also discovered that Eastman’s ties to the rodeo may have played a significant role in him wanting to protect the public image of the rodeo by downplaying the cruelty present at the rodeo. According to the California Rodeo, Inc.’s 2011 IRS  form 990, Eastman was not only listed as being on the Board of Directors, but that he had family members on the Board as well. Tim Eastman, Board Director and Veterinarian for the California Rodeo Salinas, seems to have cared more about the well-being of the rodeo’s public image than about the suffering of nearly two-dozen animals. That’s the brutal nature of rodeo. It is long past time that the veterinarians who whitewash rodeo cruelty are held accountable for their actions.

California law requires that rodeo injuries must be reported to the California Veterinary Medical Board within 48 hours of the rodeo. Rodeo Veterinarian Tim Eastman reported THREE injuries.

SHARK Calls on County Commissioners to Age-Restrict Future Rodeo Events

On July 13, 2013, SHARK videotaped a horse tripping event held at the Harney County Fairgrounds in Burns, Oregon. On August 3, 2013, SHARK published a video exposing multiple acts of horses having their legs roped and then crashing to the ground. The horses often struggled terribly to get back up.

Again, and in spite of rodeo thugs’ attempts to stop us (that will be another video), SHARK filmed brutal horse tripping in Oregon.

The only thing this video shows are horses being hurt at a public event. That the largest video sharing website in the world has declared that that footage is so disturbing that children shouldn’t see it fully exposes how violent and inappropriate rodeos are. They are not family entertainment. They are modern gladiatorial events where rodeo thugs brutalize innocent animals for the crowd’s pleasure.

“Obviously it doesn’t take a genius to understand that the person who left this poor dog; did so because they couldn’t be bothered with it any more. Obviously never heard of animal groups that would have taken it in. They are merely cold hearted bastards; using up oxygen intended for decent people. When Kaleigh Wetrich went for a walk with friends along the wooded area in north Oak Cliff County, Dallas, Texas, she never expected to find an abandoned dog, but she did.

The 6- to 8-month-old Boxer mix was emaciated and cruelly tied to a tree with a garden hose. He was deliberately left there to die.

Wetrich heard a faint bark coming from the woods. She followed the noise and found the innocent dog.

“I can’t just leave a living creature to die like that,” Wetrich told Fox News.

According to authorities, the dog that now goes by name Lucky was probably abandoned in the forest for at least a week prior to being found. Local rescue group, Apollo Rescue, saved Lucky as soon as Wetrich reported the incident.

Lucky was tied with a heavy garden hose and there was no food or water left for him. Rescuers say that he was close to organ failure but luckily he was found in time to save his life.

According to Steve Basham of Apollo Rescue, Lucky has a chance at survival. The rescue group is caring for the canine while local authorities try to build a case against the dog’s previous owner.

Finding whoever abandoned Lucky in the woods and charging the person(s) with animal cruelty will be a difficult task. The dog was left in a field with no address and there are no witnesses to this event.

Authorities encourage anyone with information to this crime to come forward.
