According to the Idaho Statesman, Idaho has been ordered to pay nearly $250,000 in legal fees for a case, that could have been avoided.
In 2012, Mercy For Animals released findings of an undercover investigation at Bettencourt Dairies in Hansen, Idaho, where workers were exposed stomping, beating, dragging, and otherwise torturing the cows.
In response to the investigation, the Idaho Dairymen’s Association drafted and sponsored anag-gag bill, which was passed by the Idaho legislature and signed by Governor Otter in February 2014. This law created a new crime: “interference with agricultural production.” It essentially criminalized undercover investigations on factory farms.
The effect of the statute will be to suppress speech by undercover investigators and whistleblowers concerning topics of great public importance: the safety of the public food supply, the safety of agricultural workers, the treatment and health of farm animals, and the impact of business activities on the environment.
The coalition of nonprofit groups that challenged the law has now been awarded$249,875.08 in legal fees. Clearly ag-gag laws are not only unconstitutional, but a huge waste of taxpayer resources. Idaho is now appealing the court ruling, which will result in an even greater waste of taxpayer money.
The governor and lawmakers of Idaho should be ashamed. They clearly don’t value their hard working constituents and will accept money from big corporations at the taxpayers’ expense.
We urge Idaho lawmakers to focus their efforts on improving animal welfare and rewarding the brave whistleblowers who uncover criminal activity in the state’s agricultural operations.
This ruling should also be a wake-up call to the meat, dairy, and egg industries that attempt to keep consumers in the dark about where their food comes from will not be tolerated.

Hidden camera video secretly shot by an investigator with Mercy For Animals at an Ohio dairy farm reveals shocking, malicious cruelty to calves and cows. The video, recorded between April and May, 2010, shows dairy farm workers beating cows in the face with crowbars, stabbing them with pitchforks, breaking their tails, and punching, throwing, and kicking calves.
No reason to try to rehabilitate or reuse terrible facility
The situation at the Edmonson County Animal Shelter should have never been allowed to happen.
Animals were discovered very malnourished, without water, covered in their own urine and feces, with urine burns on some of the animals’ feet, and some of them had obvious wounds.
Last week, the shelter’s director, Kim Carroll, of Bee Spring, was cited and charged with second-degree animal cruelty following the discovery of dozens of cats and dogs – including dead ones – in what police called an “extremely poor environment.”
It’s very unfortunate that a year after a Daily News investigative team visited the shelter numerous times and reported conditions that appeared to fall short of guidelines for shelters offered by the Association of Shelter Veterinarians that the same conditions still exist. In that investigation, it was revealed that animals were in cages too small, some were underweight and some were without water.
It’s quite obvious the newspaper’s story had no impact on those running the shelter as the conditions remained the same.
After the animals were discovered last week, several of them had to be euthanized due to the cruel conditions of this shelter.That’s a shame and a good indication that Carolland her husband, Greg, have no business running an animal shelter. The conditions these animals were found in is a clear evidence of that.
It’s truly reprehensible that someone would let animals live in these types of conditions. There is some good news out of this and that is that the shelters doors have been shuttered for now and 47 dogs and 17 cats were removed from the property. Other county agencies as far away as Owensboro also took animals from the property to their shelters.
The question now is, where does Edmonson County go from here in regards to the future of this shelter? Edmonson County Judge-Executive Wil Cannon says the county doesn’t condone wrongdoing and that the county government doesn’t own or operate the shelter in Bee Spring. He is correct. It is a for-profit business owned by the Carrolls.
Bowling Green-Warren County Humane Society Director Lorri Hare has been invaluable in getting some animals out of their shelter and getting them here. Hare has called for this shelter to be closed and has been invited to speak by Cannon before the Edmonson County Fiscal Court next week.
Hare expects the county will ask the Bowling Green shelter to take in Edmonson County animals with a contract agreement. Hare said there will only be a chance for that if the Carrolls are no longer involved at all in animal control in Edmonson County.We agree with Hare that it’s time for the Carrolls to move on to a new profession because this one certainly isn’t for them.
Cannon seems to be on the same page as Hare, which is good. Edmonson County government will have to hire, equip and properly train someone to take the animals to Warren County if something is worked out with the Warren County shelter. Barring some legal reason, Cannon plans to ask fiscal court to dissolve the county’s contract with the Carrolls.
Cannon is being proactive and taking the right approach. He should be commended for doing so. Cannon made a very good point when he said the Carrolls were given a chance last year to right whatever wrongs that may have been occurring at the shelter and they didn’t.The Carrolls simply dropped the ball and in doing so put animals at risk which in some cases resulted in animals being euthanized.
In the final analysis, this should’ve never happened. We’re glad to see that the county and Hare are working on correcting this bad situation and providing a better home for these animals. Our view is that this shelter needs to be closed permanently and we sincerely hope that is the final decision.

Goal: Prosecute woman who allegedly almost beat small Yorkie to death.
A 6-pound Yorkie was allegedly beaten by its owner. We need to take action to better ensure the person responsible gets the maximum prison sentence so that other animals will be less likely to meet the same fate.
Kristina Washington allegedly beat her Yorkie and then failed to provide it with medical care. The dog was hit numerous times in various areas of its body and it now has multiple fractures. Some of these fractures include 11 spinal fractures, five limb fractures, multiple fractures to its skull, four broken ribs and a broken foot. The dog’s left leg was also broken so many times that a part of the bone actually absorbed into the body tissue, making it less likely that the leg will properly heal.
Surgeries done on the animal have already cost in the tens of thousands of dollars. Additionally, the dog needs many more surgeries and the animal may not be able to be saved.
Urge the United States Attorney to bring this woman up on two felony counts for this alleged crime, so that she will likely have to spend 10 years in prison. Beating a 6-pound animal is both disgusting and inexcusable.

“Seriously, if you were caught using a bullhook, stick or broom etc. on a dog, cat or horse etc. whipping or poking it until it bleeds; I’m sure, you would be charged with animal abuse; & quite rightly so! These bullhooks are used to control elephants; via pain, just as various other weapons are used for the rest of the circus animals! Elephants may have thick skin, but did you know they can feel a fly land on them?? So how do you think a bullhook feels to an elephant when it’s used aggressively by an impatient trainer or handlers mucking out stalls etc. I bet it hurts like hell! Bullhooks are used to keep circus elephants in check, by tugging on sensitive parts of the elephant like their ear’s & gouging at their legs to make them perform unnatural tricks for the paying audience! Elephants were not made to entertain humans, which is why they are forced by the bullhook & electric prods (verified on undercover surveillance) to entertain! How else would one get an elephant to lift off front or rear feet, walk around a big ball with one foot on it, the other turning it, or how about getting them to do a handstand; using their trunks as a balancing aid? I’m pretty sure they don’t conform to words alone, or snacks! These elephants are performing stunts in such a way as they would never, in the wild; their bodies are simply not made to do balancing acts, it’s so unnatural for them to even consider doing tricks…but a bullhook used by a human, aimed at the right place, makes it much easier to get the job done, by causing pain. They’re not dogs who can learn a trick within half an hour using treats alone. Plus the tricks elephants are forced to do; adds injuries to their ailments later in life!!!
“Those that intentionally inflict pain & suffering & enjoy carrying out their sickening hold on animals, are not worthy of being called animal trainers or handlers etc.; they are good for one thing; picking up the mess after said animal has been to the toilet!! If they can yank an elephant round, how do the treat their family pets? They shouldn’t be or in the care of any animal; if they don’t mind whacking an elephant around its body, for simply getting a verbal command right!! Torture devices can be used right under the noses of the people, paying to watch the elephants or other animals at the circus; paying customers have no idea the animals are suffering; whilst performing ridiculous tricks! Innocent looking walking sticks can be used to enforce pain, yet they look totally harmless to the distanced crowd! However, they are anything but innocent, a simple walking stick can be turned into a torture device used on any animals whilst performing etc. Props like this can have spiked nails in one end that the trainers uses to control the animals! Those watching the performance wouldn’t be able to see nails in sticks etc…they are simply too far away; but it still looks so innocent to those watching!”
“To be honest I’m astounded that more elephants haven’t attacked, killed their trainers or gone on a rampage; like several have over the years, due to the constant abuse from humans carrying bullhooks or other items, such as a walking cane, filled with spiked nails, that when touched, cause pain etc! Could it be that elephants who were caught in the wild, remember the heartache of being taken from family & the torture chamber called the Phajaan? I’m sure those that were caught wild will never ever forget the pain of being taken from its mother & family! The Phajaan is where all wild caught small elephants are horrifically tortured daily; used for one reason other than a horror chamber…it breaks the spirit of the elephant!
Once they are in the Phajaan they can’t turn or even lay down; heavy duty rope or chains cause terrible suffering & injuries! Each foot is tied down so tightly to stop them having any chance of hurting the people who are torturing them. Rope is tied around the neck & body so there is no way they can escape! Food & water is used as a training tool too (it still is being used today) the elephants get neither if they haven’t complied with the human commands being barked at them all day for weeks or months! The elephant will stay tied in the phajaan, being whipped, poked & prodded daily to the point of bleeding from wounds!! It stops, only when & depending on how quickly the humans can break the little elephants spirit! That is what the phajaan is made for…to literally break the elephant down, both physically & mentally, until it has no fight left in it & the elephant starts to obey the human commands!! Captured young, these elephants have to be submissive before they can be trained for log work or to be sent somewhere to be trained as a circus elephant! Nobody will pay for an elephant if it will not obey human commands. The Phajaan is used as a medieval cage of wood & it succeeds in breaking the most hardened spirit of an elephant…over time the elephant just won’t be able to stand the beatings or go on without water or food; he must submit to stop the pain & he realises; he is now a slave to humans!”

OAKLAND, Calif. — The circus will stop coming to Oakland in a few years after a tool used by elephant handlers was banned in the city.
The Oakland City Council earlier this week unanimously approved an ordinance outlawing bullhooks. The instrument resembles a fireplace poker, with a sharp hook on one end that is used by trainers to control the animals.

But the circus is still holding out hope about having future performances in Oakland. “We may see if the Oakland City Council wants to reconsider,” he said. Payne said the move is a loss for people who enjoy the circus. An estimated 30,000 people attended the Oakland circus over six days last summer, he said.

The Oakland Zoo and animal rights activists supported the ordinance, saying bullhooks are cruel and inhumane. Other U.S. cities to ban bullhooks include Miami Beach, Florida.
Proponents say the tool is designed to give trainers dominance over elephants and does not hurt or harm the animal. “A lot of the information that was presented to the Oakland City Council by the proponents was designed to distort our animal care,” Payne said.
Oakland Zoo Chief Executive Officer Joel Parrott said the practice hearkens back to the turn of the 20th century and has no place in modern times.
“If I suggested using a bullhook on giraffes to get them through gates or to stab tigers to get them to do what I want them to do, everybody would react,” Parrott said. “The only reason it’s acceptable is we’ve grown used to it with the elephants.”

Despite its thickness, an elephant’s skin is very sensitive, to the point where it can feel a fly land on its back. Surprisingly, it is also sensitive to the sun, and baby elephants are even known to sunburn. The species’ notorious love for mud and baths helps alleviate both of these problems.

Unlike the rhinoceros, whose horn is made of hair-like keratin, elephant tusks are actually overgrown incisors. Incredibly long, at least one-third of an elephant’s tusk is inside the animal’s head, outside of view. The outside, ivory part of the tusk is, like its other teeth, comprised of dentine surrounded by a layer of enamel. An elephant’s tusks never stop growing.
The heaviest tusks recorded weigh about 220 pounds per tusk, while the longest ever discovered were 11 feet long! Tusks today are generally much smaller due to the ivory trade and poaching keeping them from reaching such mammoth sizes.
In a rare example of unanimity, the whole world banned the trade in ivory in 1989 with the Convention on International Trade in Endangered Species (CITES). In the decade preceding the agreement, more than half of Africa’s elephants had been killed in order to harvest the ivory, and today, poaching continues. In fact, in 2011, only a portion of the largest seizures collected found in excess of 50 thousand pounds of poached ivory. To combat this, the U.S. Fish and Wildlife Service (FWS) had proposed regulations in February 2014 that would have placed “a near-total ban on anything made with ivory moving in and out of the U.S.” However, the sweeping regulation had many concerned that it would inhibit the transportation of “old ivory,” such as that found in antique pieces of art and musical instruments. After a public outcry, particularly from concert musicians who often need to travel with their antique, ivory-fitted instruments to perform, FWS carved out an exception in May 2014.
Today there are somewhere between 400,000 and 600,000 African elephants remaining, and, unless things change, they are predicted to become locally extinct within 50 years

A new law to ban the use of wild animals in circuses is being repeatedly blocked by a trio of Tory backbenchers, despite the personal support of David Cameron, the government, Labour and over 90% of the British public.
The bill was blocked for the seventh time on Friday afternoon, a move its supporters called a “travesty” and an “outrage”. Dozens of lions, tigers, zebras and camels are still used in travelling circuses and in 2012 the government pledged to outlaw what Cameron called the “outdated practice”. But despitepublishing the draft law in 2013, it has since failed to pass it.
“It is very much a matter of a tiny number of Tory backwoodsmen preventing this from happening,” Fitzpatrick told the Guardian. “It is frustrating, but we are keeping the issue alive – it won’t go away.”
“The days of transporting wild animals in the back of lorries around towns and cities to show them off to people are long gone,” he said, noting that many nations, from Bosnia to Bolivia, already have bans and that safari parks and zoos provided alternatives. “We think Britain should join the 21st century.”

“It is a travesty that the actions of just three MPs are preventing legislation to end animal suffering from being passed,” said Jan Creamer, president of Animal Defenders International. In April, Cameron told ADI: “Yes, we are going to do it.”
A spokeswoman for the Department of Environment, Food and Rural Affairs (Defra) said the government bill would be passed “when parliamentary time allows”. However, the current parliamentary programme has the smallest number of bills for 20 years. Fitzpatrick said there clearly was time and he had “no idea” why ministers will not fulfil their pledge.
The British Veterinary Association backs the ban, stating: “The welfare needs of wild animals cannot be met within a travelling circus, in terms of housing or being able to express normal behaviour.” The RSPCA said: “Cramped and bare temporary housing, forced training and performance, loud noises and crowds of people are often unavoidable realities for the animals.”
But Rosindell, who has blocked the bill twice said: “The circus is a Great British institution, which has proved that it has the high standards of welfare which are rightly expected of it, and I strongly believe that it deserves to be defended against the propaganda and exaggerations.”
He added: “None have been taken from their natural habitat; all are from several generations of animals born in captivity. I believe it would be much more cruel to remove them from the life they have always known in living and performing with their loving owners in the environment they are accustomed to.”
Creamer said: “By blocking the bill they are defying not only the wishes of their own party and their constituents, but also the British public and Parliament. There is also clearly time to pass a ban and the government needs to act now.” A 2010 government consultation found 94% of the British public supported a ban on wild animal acts.
Maria Eagle, Labour’s shadow environment secretary, said: “The British public will be outraged that, when given the opportunity, a determined group of Tories have repeatedly dug their heels in. The next Labour government will ban wild animals in circuses.”
Fitzpatrick said: “I think a ban on wild animals will come in sooner rather than later, but I have severe reservations about whether we get it in before the election next May.”

Dynamic World of Ducks
Ducks are friendly animals who prefer to spend their days swimming in lakes or ponds. At night, ducks will sleep in groups called paddlings. Cleanliness is extremely important to ducks, who will spend hours grooming and preening their feathers and keeping their nests free of waste and garbage.
A new Mercy For Animals undercover investigation at one of the largest duck factory farms in the country has exposed rampant abuse and neglect of these gentle birds.

An MFA investigator working at Reichardt Duck Farm in California documented:
Baby ducklings having the tips of their beaks burned with red-hot metal
Ducks suffering from illness and injuries without proper veterinary care
Birds trapped in or under the wire cage flooring left to slowly suffer and die
Ducks having their throats cut while still conscious and able to feel pain
Following the undercover investigation, MFA immediately alerted law enforcement authorities to violations of California’s anti-cruelty laws and presented them with a detailed legal complaint and meticulously compiled evidence of the violations. The evidence demonstrated an ongoing pattern of cruelty, neglect, and needless suffering.
Perhaps the worst abuse factory-farmed ducks are forced to endure is life without access to water for swimming or bathing. As waterfowl, ducks evolved to spend most of their time in ponds or lakes. In fact, ducks require pools of water to maintain proper health and to regulate their body temperatures.
At Riechardt Duck Farm and most duck factory farms, these semi-aquatic animals are forced to spend their entire lives on barren, wire mesh flooring. Since their fragile legs were not meant for standing or walking for extended periods of time, let alone their entire lives, many factory-farmed ducks develop crippling leg deformities and injuries, such as “bumble foot,” a painful inflammatory infection of the bottoms of their feet.
Without access to water, ducks become stressed and start to exhibit abnormal behaviors, such as head shaking and excessive feather preening. Unable to properly clean themselves, factory-farmed ducks often develop infections and painful eye diseases that can lead to blindness. Sadly, the first and only pool of water factory-farmed ducks will see is the electrified bath as they are hanging upside down about to have their throats cut open at the slaughterhouse.
But it doesn’t have to be this way. And you can help change it. As MFA continues to expose the unconscionable cruelties inherent in factory farming, and to diligently pursue justice by aiding prosecutions of animal abusers, consumers still hold the greatest power of all to end the needless suffering and death of farmed animals by adopting a compassionate vegan diet.

“This is my personal opinion, it should have been posted a while ago, but its taken a while to write, due to pain. If people want to eat meat & dairy, I can’t stop them. But I feel they have a duty as the consumer to demand the meat they buy, hasn’t been kicked, punched or shocked around its genitals to get it moving; so it can go to slaughter! It’s plain to see (on the video) that downer dairy cows, that simply can’t move unaided, due to illness or broken bones are moved by brute force; instead of being PTS on the spot! “I have seen MANY undercover farm videos showing cruelty before…I find this, the most shocking. The public have a right & need to know how the animals they eat, are actually treated before slaughter!! If there is one video to make you ditch cheese & dairy products…hopefully it’s this one! I became a vegetarian years ago, because I didn’t want to be a party to the abuse, farmed animals suffer daily; although I know not all farms allow their animals to be treated this way! Then a few years later, I saw what happened to the dairy cows, it stopped me immediately drinking milk or eating cheese; all I could see was the images of the animals suffering. I now only drink plant-based “Alpro” milk, I prefer the Hazelnut variety which is made by taking the best whole hazelnuts & blending them with pure spring water (plus a few added vitamins & calcium of course) which I feel is far better for you than milk from a dairy cow; who has been abused her whole life!”
“Many dairy cows suffer beatings or heinous bodily abuse, throughout their life, especially on the conveyor belt of large mega dairy farms, where cows will never feel the grass beneath their feet! The only thing you can be certain of, is that the poor cow (constantly kept producing milk by artificial insemination) has its babies taken away at birth!! These farmers want the last bloody drop out of these poor dairy cows; before they will let them go to slaughter. I should imagine the cows are actually grateful, for an end to their lives of appalling abuse! I am a picky eater, but have found Quorn alternatives, to make any normal meat dishes! I love Linda McCartney’s burgers & sausages, they are tastier than the quorn versions….you name the recipe & there will be some produce, able to make it; without harming any living animal; which is the diet I choose to eat!!

To maximize profits, the dairy industry keeps cows in a constant cycle of pregnancy, birth, and lactation. Typically, baby calves are dragged away from their mothers within a day of birth so that all of their milk can be sold for profit.
Female calves are either sold for meat or used as replacements for the “spent” cows in the dairy herd. Male calves, since they don’t produce milk, are often chained by the neck in tiny wooden boxes until they are killed for veal.
Like dogs, cats, zebras, and all other mammals, including humans, cows only produce milk when they are pregnant or nursing — and for the same reason: to nourish their young. The dairy industry steals this milk from calves for humans.
An undercover investigator with Mercy For Animals documented horrific animal abuse at Winchester Dairy in New Mexico, a milk supplier to Leprino Foods — the world’s largest mozzarella cheese producer. Leprino Foods is a primary cheese supplier to Pizza Hut, Domino’s and Papa John’s restaurants nationwide. The hidden-camera video footage shows:
Workers viciously kicking and punching cows, and stabbing them with screwdrivers, causing bloody wounds and injuries
Cows being violently whipped in their faces and bodies with chains and metal wires
Workers maliciously shocking sick and injured cows and dragging them with tractors
Sick or injured cows suffering from open wounds, infections, and injuries left to suffer without proper veterinary care
Expert Opinions
After reviewing the undercover footage, renowned animal welfare experts Drs. Bernard Rollin and Terry Engle and Mr. William Wailes from the animal science department at Colorado State Universitywrote: “Of all the atrocity videos I have examined on behalf of various animal advocacy groups, this one may well depict the most prolonged, and severest pain being inflicted on innocent, non-ambulatory dairy cattle. … It is clear that the workers enjoy this infliction of pain and suffering, and even make remarks to that effect. … Of equal concern is the overall lack of training in animal care husbandry practices as well as in the importance to the social ethic of these types of unacceptable animal abuse. We all hold the owners/managers equally responsible for this egregious behavior!”
Dairy’s Dark Side
Treated as mere milk-producing machines, cows exploited and killed for milk and cheese endure lives of near constant misery and deprivation.
In order to keep producing a steady supply of milk, the cows are repeatedly impregnated. Several times a day, dairy cows are hooked by their udders to electric milking machines that can cause them to suffer electrical shocks, painful lesions, and mastitis (an infection of the udders). Some spend their entire lives standing on concrete floors; others are crammed into massive mud lots.
Cows have a natural lifespan of nearly 25 years, but the stress caused by factory farm conditions leads to disease, lameness, and reproductive problems that render cows worthless to the dairy industry by the time they are four or five years old.
These highly intelligent and social animals suffer unimaginable abuse from the time they are born and ripped from their mothers’ sides until they are so physically worn out from repeated pregnancies and constant milk production that they are sold for slaughter.

From December to February 2014, a Mercy For Animals Canada investigator worked at a Délimax veal factory farm in Pont-Rouge, Quebec. Our hidden camera captured horrific animal cruelty and neglect, including:
Calves crammed into feces-covered wooden boxes barely larger than their own bodies
Baby animals chained by the neck, unable to even turn around or lie down comfortably for their entire lives
Animals driven mad from boredom and stress, denied even their most basic natural behaviours
Workers violently kicking, punching, and tormenting baby animals
Animals painfully stuck in the wooden slats of their crates
Sick and injured animals left to suffer and slowly die in their own filth without proper veterinary care
EXPERT OPINIONS
After reviewing the undercover footage, Dr. John Webster, Professor of Animal Husbandry at the University of Bristol, and Europe’s leading expert on dairy cattle welfare, stated: “In all my experience, this is the worst, cruellest system that I have ever seen, in every sense, housing, health and stockmanship. [T]he system as seen on the video is now illegal in Europe, both in regard to individual housing, and denial of access to solid feed containing sufficient digestible fibre.”
Dr. Sara Shields agreed, concluding: “Veal crates are the epitome of a poor animal housing system, and it is almost shocking to see them still being used… Studies have shown that calves tethered in stalls have higher physiological stress responses than those kept in groups or in pairs.”
Veal is a direct by-product of the dairy industry. Since they will never produce milk, male calves born into the dairy industry are ripped away from their mothers’ sides shortly after birth and end up in veal factory farms like this one.
These calves spend their short, wretched lives languishing in their own waste inside a tiny wooden box. They never get to see the sun, breathe fresh air, feel the grass beneath their feet, walk, run, play, or do anything that makes life worth living. Their short lives are filled with misery, violence, and deprivation.
Although cruelty and violence are standard practice for Canada’s veal industry, caring consumers can help end the needless suffering of calves and other farmed animals by choosing a compassionate vegan diet.
“If you cant go fully vegan then help by trying to be a vegetarian & don’t drink milk (It’s made for animals offspring, not humans) drink soya milk instead. I drink Soya milk, Almond & Hazelnut are my favourites. They taste great to drink when cold & have quite a sweet taste (ditch the sugar) so it’s great in coffee & on cereals. Think about it, do you really want to be a party to the horrific & abusive ways, theses sentient little babies are kept in? Would you deny them the right to be with their mother’s?? Many people think being vegetarian means eating nut cutlets, rice & beans; personally I hate that type of stuff. Whatever recipes that require meat, can be made just as well with Quorn.
