A ruling by the Canadian Supreme Court said an alleged offence can only be classed as bestiality if there is penetration!
It came from a case involving a man who smeared peanut butter on his stepdaughters’ genitals and had the family dog lick it off, while filming the act.
The man, identified only as DLW, was convicted of 13 counts of sexually assaulting his stepdaughters, and jailed for 16 years.
The counts included one of bestiality – but he has now been acquitted of the bestiality charge.
The court said: ‘The term ‘bestiality’ has a well-established legal meaning and refers to sexual intercourse between a human and an animal.
‘Penetration has always been understood to be an essential element of bestiality.’
A 7-1 majority ruled that bestiality required penetration.
DLW, who also failed in attempts to make the dog perform intercourse on the stepdaughter, according to court documents, brought the bestiality conviction to the court on appeal.
Justice Rosalie Abella was the only judge to vote against the proposal.
She wrote: ‘Acts with animals that have a sexual purpose are inherently exploitative whether or not penetration occurs.’
Camille Labchuk, the executive director of charity Animal Justice, toldMetro.co.uk: ‘The Supreme Court’s decision is a wake up call that laws protecting animals are severely out of date.
“Any form of bestiality should be made illegal. An animal cannot converse, thereby cannot give it’s consent in anyway whats so ever!! So it’s clear to me that is the same as rape, no verbal communication can be given! It’s time the law was changed & these sicko’s brought to justice for such actions!”

I have gotten used to being disappointed by government but today’s shocking decision by the Supreme Court legalizing some types of bestiality leaves me speechless
The Supreme Court upheld the acquittal of a BC man on charges of bestiality, stemming from sexual abuse involving one of his daughters and the family dog. The reason for the acquittal was because the court deemed bestiality to have “a well-established legal meaning and refers to sexual intercourse between a human and an animal.” In other words, it only applies in the case of penetration and not to any other type of non-penetrative sexual activity.
“Please let’s not forget the daughter, she will have to live with this for life!”
In the 6-1 decision, the sole voice of reason was Justice Rosalie Abella who wrote:
“Acts with animals that have a sexual purpose are inherently exploitative whether or not penetration occurs.” Unfortunately her colleagues didn’t agree. Now it falls to Parliament to change the law to include both types of sexual activity.
This loophole was exposed last year when the case was sent to the Supreme Court. It is mystifying why Parliament wouldn’t have dealt with it immediately. Instead it appears to be slowed down as part of an omnibus bill that was introduced into the Parliament back in February. What’s going on? My producer wrote to the Justice Department to find out.

Fixing this section of the act requires a revision to the Criminal Code to enshrine a broader definition for bestiality. It only takes one sentence to clarify the law. The Supreme Court ruling so offends community values I have no doubt it would pass through both the House of Commons and the Senate in five seconds. It doesn’t “deserve careful study”. It doesn’t need “broad consultations with Canadians.” It just needs Parliament to do its job. Just get it done.

Putnam County SPCA officers were dispatched to the Lake Ossi neighborhood Monday after a resident reported seeing a man shooting a Canada goose and leaving its body near the shore, police said.
They determined that Gregory Stefkovic, 44, of Mahopac had shot and killed the goose with a .177 caliberair rifle. Stefkovic explained that he shot the goose because the birds left too much feces by the lake, making it unsafe for children to play there.
SPCA police charged him with animal cruelty, a misdemeanor, while DEC police issued several summons for hunting violations, police said.

Will Travers, Born Free CEO, is saddened by today’s vote at the Bangkok meeting of CITES, which soundly rejected a proposal to increase protection from commercial trade for the polar bear, imperiled by the impacts of climate change.
This species, completely dependent on sea ice for survival, has seen its number s fall to around 20,000-25,000 in recent years. This has in part been caused by a dramatic decrease in the extent of both winter and summer sea ice (showing a reduction of up to 20%) over the past 30 years, exacerbated by hunting for domestic and international trade amongst other factors.
Found in just five countries in the circumpolar region (Canada, Denmark (Greenland), Norway, Russian Federation, and the United States), this species has caught the attention of the international community in recent years as the story of their decline has become common knowledge.
So, what will CITES Parties do to increase its protection and offer a life line to the world’s largest and best known bear species…WELL NOTHING!!!!
The precautionary principle, on which this proposal was largely based states that ‘where there are threats of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation’.
So what this means is that if we are not sure of the effects an action is having, better to stop and reassess rather than proceed, possibly past the point of no return.
Today however, the Parties to CITES unfortunately threw precaution to the wind and voted not to increase global protection through greater trade restrictions despite the numerous current and ever looming threats to this species. It remains to be seen how this will contribute to the polar bear’s demise
Polar bears are inquisitive, flexible and opportunistic, adept at exploiting their Arctic habitat. Global warming is considered to be polar bears’ greatest threat and causes ice to melt earlier and freeze later.
Bears have less time to hunt, have a longer summer fast and wait longer to resume hunting, causing loss of condition andpotential conflict situations when hungry bears come in contact with people. Meanwhile in captivity, intelligent and adaptable polar bears can suffer particularly badly in zoos, circuses and marine parks.
Polar bears are dying. As global warming accelerates, the sea ice they depend on for survival is literally melting away. Bears are starving and drowning as they have to swim farther and farther to reach solid ice. Some are even turning to cannibalism in a desperate search for food. Those trapped on land hundreds of miles from the nearest ice often wander near villages in search of food and are shot.
As if that weren’t enough, oil and gas drilling is destroying and polluting their fast-dwindling Arctic habitat.
A third of all polar bears — including all bears in Alaska — will be extinct by 2050 if current trends continue.The rest of the species will be gone by the end of the century.
But it’s not too late to save the polar bear if we join together and take immediate action. The science is clear. We know what needs to be done — we just need to build the political support to do it.

An international conference of 178 member nations of an environmental group opts to allow trading of polar bear parts to continue.An international ban on trade in polar bears has been banned because of fears it would distract from the bigger threat of global warming. The proposal put to representatives of the 178 member nations of the Convention on International Trade In Endangered Species (Cites) had divided conservationists. They all agreed that the main risk to the world’s largest carnivorous land animal came from habitat loss but differed over whether international trade also put the bears at risk of extinction. Polar bears, widely seen as the animal on the front line of global warming, are predicted to be hard hit by melting polar ice caps. But the debate at the Cites meeting in Bangkok focused on the additional threat to the species posed by international trade. “The polar bear is facing a grim future, and today brought more bad news,” said US delegation head Dan Ashe who warned the polar bear population could fall by two-thirds by 2050. “The continued harvest of polar bears to supply the commercial international trade is not sustainable.” The ban was rejected by 42 votes to 38, with 46 abstentions among the nations who participated in the poll in Bangkok – the proposal needed a two-thirds’ majority support to be passed.
Polar bears are prized for their skins – particularly in Russia – as well as other body parts such as skulls, claws and teeth and their are strict controls over their international trade.
About half of the roughly 800 polar bears killed each year end up in the international trade, mostly wild bears from Canada, according to expert estimates cited by the US.
The US, Canada, Russia, Denmark (Greenland) and Norway are home to a global population of 20,000 to 25,000 polar bears.
The WWF, which chose to oppose the ban in favour of concentrating on global warming said “habitat loss from climate warming, not international trade, is the primary driver” of an expected population decline.
Canada, which hosts the largest portion of the global population of polar bears and is the only country that still exports polar bear parts, opposed a ban, citing the need to preserve the traditions of the Inuit, an indigenous minority living mostly in the north of the country.
“The polar bear advances strong emotion. It is an iconic symbol of the Arctic,” said Canadian delegate Basile Van Havre. Officers executed a search warrant Thursday at the farmhouse on 20th Sdrd., about 70 km west of Toronto, and located a ”sophisticated” indoor marijuanagrow-op, police said.
But pot was not all they allegedly found.
“While searching the residence, (officers) seized evidence related to bestiality involving a dog,” police said.
Investigators did not elaborate on what that “evidence” included.
But they claim about $9,500 in harvested marijuana, an undisclosed amount of anabolic steroids and a 12-gauge shotgun were also found in the house.
Two young kids were living at the residence with the accused couple, police said.
The grow-op was allegedly found in a separate building next to the house, both of which are tucked about 500 metres back from the road on the sprawling snow-covered property 20 km northwest of Milton.
Police allege more than 1,600 plants worth about $210,000 were seized from the building, which they claim also housed a dog kennel.
Residents of the area near Mohawk Racetrack, many of whom are horse owners, were shocked to learn of the pot operation in their sleepy community.
And they were even more disturbed by the bestiality accusations.
One neighbour said an “extremely private” older couple, possibly in their 60s, own the home.
It’s unclear how the home-owners are connected to the accused couple, both 34, and the children.
Neighbours said the older man breeds salukis, which are similar to greyhounds, and they suspect that is why there is a kennel on the property.
The home-owners’ donkey is also often seen wandering around the grounds.
Ryan Brett and Donna Fleurywere arrested and charged with bestiality and firearms-related offences.
Brett also faces drug possession, production and trafficking charges.
Fleury has since been released on a promise to appear in court at a later date.
Brett appeared briefly in a Milton courtroom Friday and was remanded into custody, so he’ll spend at least the weekend behind bars.

Police in British Columbia have issued a warning to the public about a woman convicted of killing animals but one former Toronto officer says the case reminds him of another disturbing criminal case.

Former Toronto police investigator Ross McLean told CP24 Tuesday that there are similarities between the cases of 23-year-old Kayla Bourque and murder suspect Luka Rocco Magnotta.
Bourque pleaded guilty in 2012 to wilfully killing animals, causing unnecessary pain and suffering to animals and possessing a weapon for a dangerous purpose.
The charges stem from the deaths of her family’s cat and dog.
Her recent release prompted a warning to the public issued by B.C. Corrections on Monday.
“You’re seeing similarities here between [Magnotta’s and Bourque’s] family background – it being broken, escalation to torturing and hurting animals and then the stated intent and the fantasizing about doing it to humans,” McLean told CP24 on Tuesday.
Magnotta, 30, is accused of first-degree murder in connection with the killing and dismemberment ofMontreal universitystudent Jun Lin, who police believe was killed on either May 24 or 25, 2012.
The 33-year-old’s torso was later found in a suitcase outside Magnotta’s apartment building, while his hands and feet were mailed to political offices and schools in Ottawa and B.C. His head was located in a Montreal park.
Magnotta was arrested inBerlin in July following an international manhunt.
Police believe that a video posted on-line shows the dismemberment of Lin.
On-line videos allegedly showing the torture of animals have also been linked to Magnotta.
No charges against Magnotta have been proven in a court of law. He is currently in police custody awaiting trial. “I can’t fxxxxxg believe this, there were videos of him on YouTube killing animals…yet no charges??…they going to let him out too??”
Bourque, a former student at Simon Fraser University, was sentenced to eight months in jail. Police say she will now be living in theMetro Vancouver area, but did not elaborate with specifics.
She will be subject to more than 40 court-ordered restrictions, including bans on using social networking sites, owning weapons, associating with anyone under the age of 18 and a lifetime ban on owning animals.
She will also only be allowed to leave the house between the hours of 6 a.m. and 6 p.m.
Bourque is also barred from having intimate relationships without advising the other person of her criminal past and must take part in counselling sessions and psychiatric assessments. “Yea right, so she’s supposed to say “Before I invite you in for a coffee, I have to tell you that I fantasize about killing people”…WTF, how utterly insane, she should be locked up for good!”
“It appears from the orders that the police are really working to see that [Bourque] goes in and gets the counselling she requires,” McLean said. “Now whether she wants to take it, or it works, is another story.”
Following a tip from a concerned friend last year, police conducted a search of Bourque’s residence room, where investigators seized a laptop, storage devices and a binder containing information on serial killers, as well as depictions of sexual homicide and animal torture.
Member of the public are being asked to contact police immediately if they see Bourque violating any of the conditions of her release. “I guess that means they won’t be watching her 24/7 then…un-fxxxxxg-believable!!”
She is described as five-foot-four, 130 pounds with a slender build, brown eyes and black hair.
McLean says he believes cases like Bourque’s will be more and more common.
“ We’ve raised people in a time today where – between the Internet, on-line pornography, the ability to learn about gruesome items – the environment is there right for those people to come out,” he said
While living in residence last March, she told another student she had disembowelled and dismembered cats in the Prince George area and that she fantasized about getting a gun and shooting a homeless person.
She also said she wanted to kill someone in residence and was taking forensic classes because she wanted to “get away” with something in the future.
