“We’re horrified by the video, and we are glad to hear that there’s an investigation going on,” said Keith Dane, director of equine protection for the Humane Society of the U.S. in Washington. “It appears this was made for publicity’s sake and to taunt animal lovers.”

A video posted on YouTube has sparked outrage among animal activists and left death threats against a Roswell meat company.

In the video, an employee at the Valley Meat Company out of Roswell, NM – which is working with the USDA to get a horse slaughter plant in the area – brings a horse out of its pen, swears at activists and then kills the horse with a single gunshot.

“To all you animal activists, f**k you,” Tim Sappington, a maintenance contractor with Valley Meat Company, said in the video.

He then shoots the horse point blank in the head. The horse falls to the ground and dies.

Sappington has received several death threats for the video. People who operate the plant, who contend they had nothing to do with the video, are also receiving threats.

Now, the FBI is involved.

“You know what people should be slaughtering? You f***ing s***cs, should never have been allowed in this country,” one caller said.

Rick De Los Santos, a part-owner of Valley Meat Company in Roswell, has been slammed with hate calls and death threats since a video hit the Web.

“I didn’t have anything to do with that video, that’s the honest truth, but like I said, people will make assumptions,” De Los Santos said.

De Los Santos said Sappington shot the video on his own time and at his own home. The De Los Santos’ say people have also stolen “no trespassing” signs off their property.

They’ve hired a private security firm and installed new surveillance cameras. The family says they support Sappington’s right to kill and eat horses, but not the video.

“He shot a horse, that’s what he eats, it’s not against the law to slaughter your own horse,” De Los Santos said. “Now, putting it on YouTube, I would not have done that.”

They just wish the calls would stop. “I hope you — die and your whole — family, you —in —hole,” another threat said. “This isn’t the last time you’ll hear from me —head.”

A Proposed Law Would Handle Animal Abusers Appropriately Without it: It’s A Judges Choice!

So to prevent a crime in the future, one has to deal with the culprit in the here & now! But the Judicial system is not dealing with animal abusers/killers as they should…why not?”

The man who is charged with setting fire to a cat in Bucks County must be severely punished for such a heinous crime (“Bucks man accused of burning cat can keep 2d,” Feb. 2). In addition, he must be prevented from having any contact with any other animals, even if it means depriving his son of another kitten that has been living in the home.

Animal abuse is an ominous sign. In Deadly Serious, which offers an FBI perspective on animal cruelty, Special Agent Alan Brantley recounted numerous profiles of violent criminals who had histories of animal abuse. From interviews with other agents, he found that about half of those in prison for murder had maimed and tortured animals while youths. And almost all serial killers abused animals as children. 

The psychological literature is replete with major studies that have identified the animal/human violence link. When animals are abused, people are at risk. The man who kicks the dog is just warming up. Nine of 10 abusers are male. A batterer’s first victim is often a pet. Among the men involved in both animal and human violence, the most common charges were domestic violence and child abuse. These inseparable forms of abuse must be fought as one battle.

Animal abuse is a national tragedy. We suffer from a myopia regarding the far-reaching implication. The time for corrective measures is overdue. I would suggest a nationwide campaign aimed at treating animal abuse as the serious crime it is. Until the abusers are treated like the criminals they are, we won’t change society’s attitude about the unspeakable nature of this pernicious behaviour. Animal abuse is a warning sign to be heeded. It is not a trivial matter.

Brantley emphasizes the need for stronger anti-cruelty laws and more aggressive enforcement. In a survey commissioned by the Humane Society of the United States in 1997, more than 80 percent of the respondents favoured this concept.

Also, psychiatric intervention is fundamental. Animal cruelty may indicate a family in need of professional help. It may be a symptom of a deeply disturbed family.

The tangled web of animal abuse cannot be isolated. Eighteenth-century philosopher Immanuel Kant said, “He who is cruel to animals become hard also in his dealings with men.” Animal abuse often opens the door to persistent antisocial behaviour toward humans. One’s environment does not excuse this behaviour; it only explains it.

Now we have children killing children. Too often, these youngsters show early and prolific histories of animal abuse. Anthropologist Margaret Mead said, “One of the most dangerous things that can happen to a child is to kill or torture an animal and get away with it.” Stepping in at an early point may very well break the vicious cycle of family violence.

I would urge all Pennsylvanians to contact their state senators and urge passage of House Bill 709, which has already won unanimous approval in the House. The bill, now before the full Senate for a vote, would strengthen the state’s animal-cruelty law in two ways:

Anyone convicted of cruelty to a cat or dog for a second or subsequent time would be guilty of a third-degree misdemeanor, punishable by up to one year in jail and a $2,500 fine. Now, each cat- or dog-cruelty offence is considered a summary violation, punishable by up to 90 days in prison and a $300 fine.

Upon sentencing, the trial judge would be empowered to prohibit or limit the offender from owning, controlling or having custody of animals – or to prevent his or her employment in the business of animal care.

These restrictions could be imposed for the statutory maximum term of imprisonment applicable to the offence  even if the offender were sentenced to less than the full term. Now, such restrictions, as in the case of the Bucks County case, can be imposed by a judge only as a condition of bail.

This law would send another firm message that society will not tolerate animal abusers.

Feds Bring First Case Under New ‘Animal Crush’ Video Law

A Houston man and woman were indicted Wednesday for producing “animal crush” videos, the first federal case brought under the Animal Crush Video Prohibition Act of 2010, which was passed after the Supreme Court ruled that a previous version of the law violated the First Amendment.

The U.S. attorney in southern Texas charged Ashley Nicole Richards, 22, and Brent Justice, 51, who are already facing state animal cruelty charges, with producing eight videos that allegedly involve the torture and killing of puppies, chickens and kittens, according a release from the federal prosecutor’s office. Richards and Justice face five counts of animal crush charges and two obscenity charges.

A spokeswoman for the U.S. attorney’s office of Southern Texas confirmed the Houston case is the first in the nation brought under the revised law.

In April 2010, the Supreme Court decided 8-1 in U.S. v. Stevens to strike down Section 48 of Title 18 of U.S. Code as unconstitutional.

The code, Chief Justice John Roberts wrote in the opinion of the court, penalized “anyone who knowingly ‘creates, sells, or possesses a depiction of animal cruelty,’ if done ‘for commercial gain’ in interstate or foreign commerce.”

That case involved a man who sold videos of dogfighting and of dogs attacking other animals. He challenged his indictment on the grounds that Section 48 violated the First Amendment.

Though the government argued the code was necessary for cases of “animal crush” and animal fighting videos, the court held “a law may be invalidated as overboard if ‘a substantial number of its applications are unconstitutional.’” The court, therefore, did not discuss whether animal crush videos were a special case that could warrant an exception to the First Amendment.

“We … need not and do not decide whether a statute limited to crush videos or other depictions of extreme animal cruelty would be constitutional,” Roberts wrote for the court.

The court invalidated the law altogether as overboard, prompting Congress in September of that year to pass the Animal Crush Video Prohibition Act of 2010, which specifically prohibited animal crush videos and defined them as “any photograph, motion picture, film, video or digital recording, or electronic image that:

(1) depicts actual conduct in which one or more living non-human mammals, birds, reptiles, or amphibians is intentionally crushed, burned, drowned, suffocated, impaled, or otherwise subjected to serious bodily injury;

(2) is obscene.

The “and obscene” provision would be key if the statute were challenged anew, said First Amendment expert and University of Chicago law professor Geoffrey Stone.

“[Congress] passed this very complicated law that does not add anything to the scope of what is criminal,” Stone told POLITICO. “So as long as we stipulate that the material has to be obscene to be prosecuted under the statute, then why don’t you just prosecute you under the obscenity statute?”

The reference to obscenity also appears to limit the statute’s application in several ways, including limiting it to videos that are sexual in nature.

Stone believes that if the case were to be brought to the highest court, the question at issue would be whether there is a legitimate reason to distinguish this type of obscenity from others.

With free speech restrictions, the government cannot constitutionally pick and choose what type of speech to restrict based solely on its content, as established in the hate speech case R.A.V. v. City of St. Paul.

Stone compares the animal crush statute to a law creating higher penalties for purveyors of homosexual obscenity as opposed to non-homosexual obscenity – the government in both cases would need to show why the distinction serves a societal necessity.

Stone said in defence of the law, as in the comparable issue of child pornography, sometimes the government punishes selling depictions of something cruel to take away the incentive for individuals to commit the cruelty in order to profit off of it.

The animal crush statute carries a maximum penalty of seven years in prison; the obscenity statute carries up to five.

Pennsylvania Horse Doused With Flammable Liquid, Set On Fire

 

“As the perpetrators have not been found yet, I would suggest people living around that area, to keep a close eye on their pets. Whoever did this, obviously got a kick out of seeing it suffer, they are inhumane, cold, calculated & heartless bastards; so just be aware! When caught, they need to have the maximum sentence thrown at them! I can imagine how the owners feel about this sick revolting act. Some people have horses & see them as objects for bringing home money etc., others, like me & this lady in question, see them as part of the family. I wish Northstar a speedy recovery & hope this incident doesn’t have any lasting effect on his normal behaviour!”

UNION CITY, Pa. — A horse was struggling to survive Tuesday after being doused with a flammable substance and set ablaze over the weekend.

“I don’t know what would have possessed anyone to do this. I just know they are sick. They are a sick, sick person,” Jessie Woodworth, owner of the 6-year-old gelding named Northstar, told The Huffington Post.

“It’s a person with a degenerate mind,” Woodworth’s husband, Bob, added. “It would have been much more humane if the person had shot the horse instead of making it suffer.”

The Woodworths boarded Northstar at a 60 acre ranch in Athens Township. Family members found him severely burned on Sunday morning.

“My wife and daughter found him hiding in the woods,” Bob Woodward told HuffPost. “He was completely out of it — in shock. The girls heard him whine for them. He was a mess and you could see where a liquid was poured on him and he was set on fire.”

The Marley Veterinary Clinic in Titusville is treating Northstar. The animal is being administered pain medication and antibiotics. Prescription ointments are being used to help heal the wounds.

“He’s not over it by no means,” Bob Woodworth said. “He has burns all over his body. His face is burned right down to bone, his eyelashes are burned off and the hair in his ears and nostrils is gone. I don’t know how the animal survived. It’s going to be a long battle. It’s going to take him a long time to recover.”

State troopers from the state police barracks in Corry are investigating. The individual or individuals responsible used an unknown accelerant to set the horse on fire, police said. No arrests have been made and no suspects have been named.

The Woodworths said they have no idea who targeted their horse.

“This is a member of our family. We raised him from birth. There is nothing this animal has done wrong to nobody,” Bob Woodworth said.

Animal cruelty is typically caused by people who are angry or have demented personalities, said Sarah Speed, Pennsylvania state director for the Humane Society of the United States.

“There have been a number of psychological studies done and we are learning that people who commit these types of crimes are typically angry and they turn to someone who is more vulnerable, like a child or an animal,” Speed told HuffPost.

“The truly disturbing thing about fire-setting animal abuse is that it is one of the three strongest indicators of a future serial killer, as defined by the FBI,” Speed continued. “When a child has one or more of those psychological symptoms, there is cause for concern that they lack empathy that could result in future violent crimes.”

In Defense Of Animals Doubles Reward In Minneapolis Cat Cruelty Case

Reward fund now totals $2,000 to convict person(s) who stabbed and set cat on fire

Minneapolis, Minn. (August 16, 2012) – In Defense of Animals (IDA), an international animal protection organization based in California, has added $1,000 to a reward fund for information leading to the arrest and conviction of whomever stabbed, then burned to death a cat in a Minneapolis park. This brings the total reward to $2,000.

On August 12, police responded to a call from park employees who found a dead cat in the Longfellow Park and Recreation Center, a voting location used in Tuesday’s primary election. The cat’s throat had been slit, she had been set on fire, and a small American flag had been stabbed into her body. There was also an Obama/Biden lawn flag stuck in the ground at the site. That prompted interest from the FBI, Secret Service, and the Department of Homeland Security, who are also investigating.

The Minnesota Federated Humane Societies (MFHS) has posted a $1,000 reward for the arrest and conviction of the person(s) responsible. “This despicable act of animal cruelty will not go unpunished,” said MFHS General Council Representative Tim Shields to WCCO, the local CBS affiliate. “Those responsible for this cruel, torturous death of a house pet will be prosecuted to the fullest extent of the law.”

IDA has pledged to double that reward to encourage someone to come forward with information. “Whoever would commit this grotesque crime is a danger to us all.” said Jack Carone, Communications Director of IDA. “We know beyond a doubt that animal cruelty is a precursor to violence against humans. Someone knows something, and we ask them to come forward, both in the interest of justice for this poor animal and for the safety of the community.”
