At this moment a 16-year-old Siberian-Bengal tiger named Tony is caged at a gas station truck stop in Grosse Tete, Louisiana, 20 miles outside of Baton Rouge. Confined to a cramped metal cage, Tony breathes in diesel fumes daily while passersby tease and harass him. Tony has lived this way for nearly his entire life, and his circumstances are often a shock to the average person, who feels innately that this is not the right place for a tiger, especially an ageing one with neglected veterinary needs. People ask, “how can this be legal?” and the Animal Legal Defense Fund believes firmly that it’s not. In fact, we’ve been fighting for over six years to have Tony relocated to a sanctuary that can meet his complex needs and give him the veterinary care he is entitled to. Our campaign to save Tony is now even more dire after reports raising concerns about Tony’s health.

Let Tony Live the Rest of His Days in Comfort

All across the world, people follow Tony’s story. Recently, we’ve received many reports from worried citizens stating that Tony appears lethargic and is experiencing diarrhoea and a decreased appetite. The Animal Legal Defense Fund obtained photo and video evidence and enlisted the help of a veterinarian with experience treating exotic animals to review it. In the vet’s expert opinion, Tony is likely suffering from kyphosis of the spine and an injury or other condition that is causing him to limp. This isn’t run-of-the-mill ageing; Tony needs help. Living at a truck stop is, at the least, exacerbating Tony’s poor health. While no animal is suited to living at a truck stop, tigers are particularly ill-equipped because of their sharp sense of smell and sensitive hearing. Independent of all our pending legal work to free Tony, the Animal Legal Defense Fund just submitted a letter to the U.S. Department of Agriculture (USDA), which licenses the Truck Stop under the federal Animal Welfare Act, urging that Tony be inspected by a licensed specialist and given any necessary veterinary care.

The Legal Battle for Tony’s Safety

We believe that Tony, and all big cats held in captivity, deserve to live in environments that meet their psychological and physical needs. Our campaign to remove Tony from his particularly grim captivity at Tiger Truck Stop has been lengthy and determined. Michael Sandlin, the owner of the truck stop, however, has pulled out all the stops to keep Tony in captivity.  He has spent over $750,000 fighting our efforts and has also manipulated the legislative system by successfully lobbying the Louisiana legislature to pass a special exemption designed solely to benefit Sandlin and allow him to keep Tony. It’s no surprise that Sandlin puts up such a fight; he’s been exploiting tigers like Tony for decades, using them as a gimmick to lure customers to his gas station. The USDA has cited Sandlin numerous times for violations ranging from failure to provide veterinary care to lack of clean drinking water. In 2003, Sandlin relinquished three tigers amid public outrage over his treatment of the big cats. Only Tony remains.

Inspired in part by Tony’s plight, then Representative Warren Triche, Jr. introduced legislation in 2006 to ban private possession of big cats in Louisiana. The law passed, and while it was a tremendous win for the big cats saved from being the next Tony, Sandlin continued to hold Tony in violation of the law. The Animal Legal Defense Fund sued the Louisiana Department of Wildlife and Fisheries for unlawfully issuing Sandlin a permit to exhibit Tony. We were joined in the suit by former Rep. Triche, Jr. and several other Louisiana taxpayers. Both the trial court and the Louisiana Court of Appeal held that Sandlin and the Tiger Truck Stop were ineligible for a big cat permit and could no longer keep Tony captive. In October 2013, the Louisiana Supreme Court let that decision stand. Still, Tony remained at the truck stop.

Despite the Animal Legal Defense Fund’s victory, which should have freed Tony and allowed him to be moved to a sanctuary, Sandlin has been able to keep Tony in captivity because of two legal tactics that he has pursued relentlessly.

First, after the trial court ruled against Sandlin and while his appeal was pending, he filed a separate lawsuit challenging the big cat ban as unconstitutional.  The Animal Legal Defense Fund, along with concerned Louisiana citizens, promptly filed a petition to intervene in that action to defend the constitutionality of the big cat ban.  Both the State of Louisiana and the Animal Legal Defense Fund argued Sandlin’s claims were barred because he failed to raise them in the Animal Legal Defense Fund’s prior action.  Those arguments are still pending today, nearly five years later.

Second, Sandlin manipulated the legislative system by successfully lobbying the Louisiana legislature to pass Act 697, a special law designed to exempt Sandlin – and only Sandlin – from the big cat ban. It was signed into law by then Governor Jindal. The Animal Legal Defense Fund again immediately went to work, suing the state of Louisiana and arguing Act 697 violated the Louisiana Constitution because it was a “special law” designed to benefit one individual from existing state public safety and animal welfare laws. We were again joined in the suit by former Rep. Triche Jr. and other concerned Louisiana citizens.

We’re Not Giving Up

The Animal Legal Defense Fund recently combined its challenges to both of Sandlin’s legal tactics into the same action, filing an amended petition in intervention in Sandlin’s lawsuit that challenged the constitutionality of the big cat ban.  This will allow the Animal Legal Defense Fund — in one motion — to raise arguments both challenging the constitutionality of Act 697’s exemption for Tony and explain why Sandlin’s challenges to the big cat ban itself should fail.  A ruling in favour of the Animal Legal Defense Fund on such a motion should finally put an end to Sandlin’s legal tactics and provide a final resolution allowing Tony to be relocated to a sanctuary.

As the world watches the ups and downs of the fight to save Tony, the tiger’s life remains essentially the same. He doesn’t know his story inspired a former Representative to come out of retirement to fight for him, or that the big cat ban will help others of his kind. All he knows is life in a cramped cage off the highway. Tony deserves the veterinary care he needs and to live out the rest of his life in peace. He doesn’t just deserve it, we believe he’s guaranteed it under the law. We won’t stop until Tony is safe

Comedian Alexei Sayle has joined Animal Defenders International (ADI) in calling for action on wild animal circuses, urging Government “to get a move on” and “bring their own bill in” as a backbench bill to bring in the ban promised, but sat upon by Government, faces its tenth attempt to pass to committee stage.

Incredibly, it is Conservative back benchers who have blocked this bill to pass their Government’s own legislation nine times.

Opposition to the use of wild animals in circuses is overwhelming, with support for the ban uniting Parliament and the public alike. Legislation has now been pledged by Government for three years, with the promised ban due to come into force at the end of this year. ADI is urging David Cameron to keep his word and progress the law.

ADI President Jan Creamer said, “The Government made a clear promise to act on this issue yet three years on we are still waiting for the law to pass. The public and Parliament do not want to see wild animals continuing to suffer in British circuses. David Cameron must keep his word and bring in the ban without delay.”

Social justice campaigner Peter Tatchell joined Alexei Sayle in the plea for action stating he hoped David Cameron “will stop his foot-dragging and bring forward legislation to ensure there are no more wild animals in circuses in Britain” alongside X Factor boyband Fifth Street who said that the ban would “keep the public happy and keep the animals happy.”

Angela Eagle MP today attempted to progress the ban by asking William Hague, Leader of the House of Commons, if the Government would give the Circus Bill time for a Second Reading. He responded: “I certainly support that Bill and the Government supports that Bill. I think it would be wrong for the Government to pick bills out of the Private Members’ process and give them Government time… the Bill will have to take it’s normal chances.”

This seems extraordinary double-speak since the bill was promised by the Government over two years ago and is only in the Private Members’ process because the Government has not given it time.

The issue has become an embarrassing Parliamentary saga. The proposed ban on wild animals in circuses was announced by the Government in 2012, although a ban was promised to Parliament as long ago as 2006. In 2010 a Government Public Consultation saw over 90% of respondents calling for a ban and in 2011, backbench bench MPs voted unanimously for the Government to introduce a ban.

The Private Member’s Bill introduced by Jim Fitzpatrick MP is identical to the Government’s own Bill that was unveiled to media fanfare but has simply gathered dust. Unfortunately, an objection from just one MP prevents it from progressing, and tomorrow eyes will be on Tory MP for Christchurch, Christopher Chope, who has blocked the bill on six occasions.

Wales is committed to a ban and is seeking to be included in England’s legislation, but whilst efforts to ban wild animals in circuses are stalling, 30 nations around the world have acted. ADI is currently assisting the Peruvian Government enforce a ban and have 21 lions in their care removed from circuses.

ADI’s campaign to stop circus suffering in Britain is supported by politicians of all parties, leading animal protection groups and celebrities including Ricky Gervais, Dame Judi Dench, Brian Blessed, Twiggy, Eddie Izzard and Sir Roger Moore.

ADI has vowed not to let the matter drop and the backbench bill will have another second reading on Friday 27 February.

Go to your local Post Office, any facility that sells stamps. Refuse to buy the Ringling Bros. Barnum and Bailey Circus stamps !!!!  Tell them to stop advertising these stamps!!!!…..The brutality the Wild Animals in the Circus suffer from is not a joyous event!!!  Wake up people!!!!   Stop the abuse happening under “THE BIG TOPS“…..You can make it possible for these magnificent beings to live a life without being beaten into doing the stupid insulting tricks they are forced to do. None of the Wild Animals do these circus routines in the wild!!!!
Nor do they do them when not in the ring!!!! These animals are living a life of cruel and unusual punishment. When not in the ring they are chained or in small cages . This is animal abuse solely for financial gain for humans. The Cirque du Soleil is magnificent, uses no wild animals and the acrobats LOVE doing the aerobatics, it is their lifetime careers……There is never a need for wild animals to suffer. Do not buy the circus stamps!!!  And PLEASE, do not attend THE BARNUM & BAILEY CIRCUS or any circus where wild animals are being exploited, and they all are!!!!!!

“Please, if you care about wild animals being exploited for entertainment & money, take action & send an email to the links below; I don’t know about you, but I am sick of being hoodwinked! The BRITISH Government are stalling for some reason, whilst other Countries (even those known for their poor welfare of animals) have managed a ban….why not England?? All those in government need to watch the video at the end of this post, even though posted in 2010, little has changed, for animals are still being beaten into submission by cruel trainers, taking their own frustrations out, on sentient beings, who can’t speak about the abuse. Circuses are interested only in the money their animal performances bring in, which brings horrific suffering to those entrusted to entertain…THE ENGLISH GOVERNMENT HAVE TO HONOUR THEIR PROMISE OF A BAN ON WILD ANIMALS IN CIRCUSES ASAP…I only feel total empathy & sorrow for those sentient beings left, like horse & dogs etc. Who will still suffer the abuse, confinement & training of circus life; it’s heartbreaking to see horses with stereotypical behaviour!”

In the UK, we participated in a government-convened Circus Working Group in the late 1990s and again in 2006. We have investigated and exposed the treatment of wild animals in circuses on many occasions, and helped to relocate animals from circuses to better conditions.

Numbers of circuses with wild animals and the number of wild animals used by circuses have declined in recent years but we consider that a ban on wild animals in circuses across the UK is long overdue. travelling circus environment simply cannot provide for the needs of wild animals.

 URGENT! – ASK CAMERON AND CLEGG TO BRING CURTAIN DOWN ON WILD ANIMALS IN CIRCUSES

Dear Supporters and Friends

I was shocked when I discovered that the ban on wild animals in travelling circuses in England was not mentioned in the Queen’s Speech in June 2014. I am sure you are as disappointed as I am.  But I will certainly not give up.  There is still a slim chance that the Government could make the dream of a ban a reality – but I need your immediate help.

It is vital that the Prime Minister and Deputy Prime Minister hear from compassionate citizens as a matter of urgency and I am, therefore, asking you to take 5 minutes to contact them, urging them to ensure that a ban is introduced by Government as a priority.

The key points to make in your letter or email are:

  • The Government made a commitment to bring in a ban on wild animals in travelling circuses in England in March 2012, and has repeatedly confirmed their commitment ever since.
  • There is now a very limited window of opportunity for the government to make good on its promise of a ban within this session of Parliament. Parliament is scheduled to be dissolved at the end of March 2015.
  • Draft legislation to ban has already been introduced in Parliament. This legislation is not considered to be controversial, has the overwhelming support of Parliamentarians, and could progress quickly through Parliament.
  • There is strong public support for a ban which would be a quick and easy “win” for this Government.
  • Any delay in bringing in a ban in England could reduce the chances of bringing in bans in Wales, Scotland and Northern Ireland.
  • Leading animal protection organisations including the Born Free Foundation, RSPCA, the Captive Animals’ Protection Society, and the British Veterinary Association are all agreed that a ban is long overdue.
  • Quite simply, a ban is the right thing to do in a compassionate society that cares about animals and we must not let this opportunity be lost!

The Ugliest Show on Earth report (USoE) and video chart the findings of an 18-month study and investigation into the use of animals in circuses – the most comprehensive study of animals in circuses ever undertaken.

Between 1996 and 1998, ADI undercover Field Officers worked in 13 UK animal circuses and winter quarters, and 5 foreign circuses which were exhibiting animals supplied by UK circus animal suppliers and trainers.

The team of five people involved in the undercover work made observations totalling 7,280 hours. Over 700 hours of videotape was recorded, with nearly 400 hours of this being used in evidence for the prosecutions which followed the publication of the report and release of the video programme of the same name.

The video highlights the main findings of the study and is probably most famous for the shocking scenes of brutality to elephants and chimpanzees at Mary Chipperfield Promotions in Hampshire, UK. These scenes allowed ADI to issue summonses for cruelty to animals which were subsequently taken over by the UKs Crown Prosecution Service, and convictions for cruelty were secured against Mary Chipperfield Cawley, her husband Roger Cawley, and their elephant keeper, Michael Steve Gills.

Backers of the Concentrated Animal Feeding Operation anti-videoing legislation — “ag-gag” — have already lost the war, even if the legislation passes. Especially if it passes.

Their best hope is to change strategy.

Senate Bill 1337, which has passed the Senate, bars a person who “without the facility owner’s express consent or pursuant to judicial process or statutory authorization, makes audio or video recordings of the conduct of an agricultural production facility’s operations.” More specifically, it’s intended to ban (though various existing laws already theoretically do) the videotaping of what happens to livestock in concentrated animal feeding operations.

This is significant in Idaho, home to some very large CAFO operations in the Magic Valley and southwest. The new bill would punish violators with up to a year in jail or a $5,000 fine; critics note that’s the same as the state penalty for animal abuse.

Similar legislation has been proposed, most often failing to pass, in more than a dozen states; a Utah law is being challenged in the courts.

The Idaho bill was specifically prompted by a video shot in 2012 at Bettencourt Dairy at Hansen, showing workers beating on livestock. Last week another video shot at an Idaho CAFO, which added animal sexual abuse to the mix, was released. Both have had many, many views, and they’ve gone viral on social media.

We can’t know if the videos alone would have generated massive international attention. We do know the videos, combined with legislation to ban shooting more of them, has sent interest in the subject sky high in news reports nationally and overseas.

The story is irresistible: An attempt to keep the lid on what people have already seen. But memories aren’t so easily erased. Nor is the technology, which keeps moving in the direction of disclosure, as privacy advocates regularly remind us.

Among other responses to the bill are petitions — some inside Idaho, some by national animal advocacy groups. Petitions usually do little by themselves, but they can assist organization efforts, and they keep the subject visible.

Not only are smaller and relatively hard-core groups like Mercy for Animals, which released the Bettencourt videos, involved in this, but also larger and better-funded groups like the Humane Society of the United States. The subject of CAFO livestock has gone mainstream.

If you doubt that, watch the latest series offering from Netflix: The satirical but pointed “Farmed and Dangerous.” The initial plot hook involves an exploding cow. Once issues like this get into cultural discussion, national regulation and legislation may, in time, follow. It’s in the spotlight now.

The Magic Valley has benefited recently from arrival of a number of food processors who came there largely because of the easy supply of dairy products. Don’t be surprised if boycotts of some of them start — and lead to business responses. To see this playing out, Google the Wiese Brothers Farms in Wisconsin and read about the videos and other reports that led a frozen pizza company to cut all ties with them.

Nor is that all. If SB 1337 is signed into law (as seems likely), watch for this: An activist who deliberately violates it, shooting more video, intending to get caught, and insisting on a very public trial that could draw more national and international attention, kicking in the cycle all over again.

The problem for livestock operations is not insoluble. The simplest out is to improve and closely monitor operations, then throw open the doors for public viewing.

Some CAFO advocates have argued that much of what has been shown on the videos has been unusual aberrations, that most livestock is treated better before slaughter than the videos suggest. An open-door policy would be the one practical way to prove it.

Some of what inevitably happens in the best of meat processing businesses is of course difficult for many people to stomach, but the operators could fairly argue that if you want your meat at the supermarket, this is how it has to get there. Since most people do want their steaks and burgers, the argument might settle down, on at least higher ground than it occupies now.

Legislation has its uses. But CAFOs here have among other things a public relations problem, and these kinds of laws seldom are much help with that.

On the heels of the recent viral diarrhea outbreak, yet another virus is plaguing pigs on factory farms in the Midwest, this time in Ohio.

National Hog Farmer” magazine reports, “A new coronavirus has been identified in pig fecal samples from four Ohio swine farms, according to the Ohio Department of Agriculture.”The article explains that although the symptoms are similar to the ongoing outbreak of Porcine Epidemic Diarrhea Virus (PEDV), this is an entirely new coronavirus born of extreme confinement on today’s hog farms.

And according to “Feedstuffs,” the samples were taken from farms that “experienced outbreaks of a diarrheal disease in sows and piglets in January and early February.” The Ohio Department of Agriculture has yet to determine whether this new virus is the cause of the diarrheal outbreak.

Subjecting animals to a lifetime of confinement in crates so small they are virtually immobilized is perhaps the cruellest form of institutionalized animal abuse in existence. Combined with overuse of antibiotics, and unsanitary living conditions, these factory farm environments create a breeding ground for disease.

TodayThe Humane Society of the United States released horrifying hidden-camera video footage of pigs being fed diarrhea and the ground up intestines of their own piglets at a factory farm in Kentucky – Iron Maiden Hog Farm.

Although the practice of feeding pig guts and shit to other pigs is common on industrial farms across the country, it is illegal under state law

The video, which was profiled by The New York Times, also shows mother pigs crammed into filthy metal cages so small they can’t even turn around or lie down comfortably for nearly their entire lives. Seemingly without irony, the facility is named after a medieval torture device by which human victims were confined in a metal box barely larger than their own bodies.

An undercover exposé of Iron Maiden Farms in Owensboro, Kentucky revealed that sows confined in cramped cages known as gestation crates were fed intestines from ground up piglets who had recently succumbed to a highly contagious diarrhoeal disease.

Like a medieval torture device, the use of gestation crates by the pork industry is perhaps the cruellest form institutionalized animal abuse in existence.

In fact, these crates are so cruel they have been banned in nine states and the entire European Union. In the last couple years, more than 60 major food providers, including Costco, Target, Safeway, Kroger, and others, have committed to phasing gestation crates out of their supply chains. Even major pork producers like Smithfield and Hormel have recognized the need to do away with cruel crates.

Unfortunately, Walmart, the largest pork retailer in the world, continues to support factory farms that keep pigs in gestation crates. An investigation by ADI into a Korean “attraction” that forces monkeys to perform in degrading shows has revealed shocking conditions behind the scenes.
At the Monkey School, which is located in Gamgyori in South Korea, ADI found:

  • Monkeys kept in squalid and barren conditions, including mothers and their young babies
  • Traumatized animals exhibiting abnormal behaviour, such as constantly spinning around and biting themselves
  • Some monkeys isolated in tiny cages, others crammed together
  • Animals hit during training and dragged along the floor
  • Disgraceful contempt for a monkey as it tries to escape with its hands tied behind its back, falling onto its face, as workers laugh at its predicament and terror

These disturbing findings highlight a life of extreme neglect and cruelty for these intelligent and sensitive animals – an all too common occurrence for performing animals which ADI has revealed time and again, suffer terribly behind the scenes.

On seeing the footage, Sharon Shaw, Director of Lakeview Monkey Sanctuary in the UK said: “All aspects of life for primates at Monkey School are appalling, from the inadequate and atrocious housing conditions, the physical and psychological torture, to the lack of empathy and respect shown by the staff. The poor animals who are unlucky enough to live there endure a barbaric, unnatural life.”

During the public shows, monkeys are made to wear clothes, ride around on a motorbike, do handstands, jump through hoops and respond to commands as directed.

It is shameful that these intelligent, social and emotional primates are terrorized and forced to undertake such degrading tricks – especially in light of modern understanding of primates and their use of tools, language and self-awareness – abilities which, at one time, were considered to be unique to humans. This also sends the worst possible message to children about respect for the other intelligent species that share our planet and how we should treat, and protect, animals.

The terrible suffering of the animals at Monkey School – and establishments like them – must stop.

ADI is working with our campaign partner Korea Animal Rights Advocates (KARA) to encourage the Government and people of Korea to reject the cruel and unnecessary use of animals in entertainment.

We are supporting new legislation, the ‘Zoo Act’, proposed by Congresswoman Chang which, if passed, would ban animal performances and set minimum welfare standards and inspections for places that exhibit captive animals.

Highlighting the need for the legislation, Congresswoman Hanna Chang: “As seen in the ADI footage, it is hard to imagine the pain that monkeys have to go through for humans every day. This clearly shows that it is now time to have regulations to monitor the welfare of animals in captivity in Korea.”

Congresswoman Chang’s proposal has strong support from animal protection organizations. ADI and KARA have joined over 80 national and international groups in sending a joint letter to the Government stating support for the draft law.

It is time to end the exploitation of, and brutality towards, animals used for entertainment.
